1. About Penciland and These Terms

Welcome to Penciland. These Terms of Service and Personal Licensing Agreement ("Terms") govern your access to and use of our website (penciland.com) and all digital publications, printable files, bundles, and free sample materials provided herein.

Operator Identity: The website and brand Penciland are operated by Penciland Creative Studio, an independent digital publishing studio established in the Dominican Republic and serving colorists worldwide. In these Terms, "Penciland," "we," "us," and "our" refer to the operator identified above.

By accessing our website, downloading our free sample sheets, or purchasing any digital edition, you acknowledge that you have read, understood, and agreed to these Terms. Nothing in these Terms excludes or limits statutory consumer rights that cannot lawfully be waived under your local jurisdiction's consumer protection laws.

2. Nature of Digital Products (No Physical Shipment)

All publications offered by Penciland are 100% digital goods supplied as high-resolution (300 DPI) master PDF files and raster artwork optimized for standard US Letter (8.5 x 11 in) and International A4 paper sizes.

No physical products are delivered by postal mail: Purchases do not include paper coloring books, art supplies, physical markers, pencils, printers, or tablet devices. Customers are responsible for providing their own printing equipment, paper, or digital coloring applications (such as an iPad with Procreate or GoodNotes).

3. Personal-Use License Grant

Upon payment of the applicable purchase fee (or upon authorized receipt of free promotional sample sheets), Penciland grants the authorized license holder a non-exclusive, worldwide, continuing license to use the purchased digital illustrations solely for personal, non-commercial purposes.

This license is an authorization to use and reprint the artwork; it does not constitute an assignment or transfer of the underlying copyright or intellectual property. Except through an authorized gifting procedure as detailed in Section 6, the license is personal to the designated license holder.

7. Orders, Pricing & Checkout Partners

Product prices are displayed in United States Dollars (USD) unless a localized currency is displayed during checkout. Applicable taxes (such as state sales tax or VAT, where legally required) are disclosed before you finalize payment.

Checkout facilities and payment processing are supported by our technological partner Whop Inc. ("Whop") and its authorized payment gateways (including Stripe, Apple Pay, and Google Pay). All transactions are processed through tokenized, encrypted connections under PCI-DSS Level 1 security standards.

All individual books are sold as one-time purchases. We do not enroll customers in recurring subscriptions or hidden recurring fees without explicit prior agreement.

8. Digital Delivery & Customer Backup Responsibility

Immediately following payment confirmation, an instant download button is rendered on your screen, and an electronic order confirmation containing your personal access link is transmitted to your provided email address.

Continuing License vs. Hosting Availability: Your personal license to reprint and color purchased artwork continues indefinitely. However, third-party hosting platforms and server technologies evolve over time. We strongly advise all customers to download and maintain a secure local backup copy of their master PDF files on their own computer, cloud storage, or external drive.

If your download link expires or your files become corrupted, our customer support desk will assist you in restoring access in accordance with our 14-day technical guarantee.

9. Refunds, Immediate Supply & Statutory Consumer Rights

Because our digital goods are supplied immediately upon payment and cannot be physically returned, voluntary refunds for change of mind are generally restricted once files have been accessed or downloaded.

Statutory Consumer Rights: Nothing in these Terms limits or excludes non-waivable consumer rights under applicable laws. In jurisdictions where statutory rights of withdrawal apply to digital content (such as in the European Union or the United Kingdom), you acknowledge that by proceeding to instant download, you request immediate digital performance. If a file is defective, corrupted, or materially fails to match its description, you remain entitled to legal conformity remedies, including repair, replacement, or a refund.

11. Intellectual Property & Protectable Assets

Penciland and its lawful licensors retain all rights, titles, and interests in the website, illustrations, compositions, cover designs, brand marks, and digital publications. Certain fonts, graphic tools, and technical assets incorporated into our platform are licensed from third parties under their respective commercial terms.

Purchasing an edition grants only the personal use rights explicitly detailed in Section 3 and Section 4; it does not transfer artistic ownership or copyright. We respect the intellectual property of others and will investigate any substantiated notice of infringement sent to our contact email.

12. Customer Reviews and User Content

If you voluntarily submit a customer review, rating, or photograph of your colored artwork, you confirm that your submission reflects your authentic, personal experience with the purchased edition.

By submitting review content for public display on penciland.com, you grant Penciland a non-exclusive, royalty-free, worldwide license to display that review and photograph in connection with the relevant product. We reserve the right to moderate or remove submissions that contain spam, defamatory content, harassment, or personal contact details. We never condition customer feedback on positive ratings.

14. Warranties and Limitation of Liability

Our digital publications are created for creative leisure and mindful relaxation. We make no medical, clinical, psychological, or neurological claims regarding coloring. Coloring is an artistic pastime and should not be considered a substitute for professional healthcare.

To the maximum extent permitted under applicable law, we disclaim all warranties not expressly provided in these Terms. In no event shall Penciland's aggregate liability exceed the total purchase price paid for the specific digital edition giving rise to the claim. Nothing in this section restricts liabilities that cannot lawfully be limited under mandatory consumer protection statutes.

15. Applicable Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Dominican Republic, without prejudice to any mandatory consumer protection regulations that apply to you in your country of habitual residence.
